The appeal of VAKS upheld the acquittal in the case of preferential tariffs from UZ

The appellate instance did not see grounds for overturning the acquittal of three former officials of the state university.

The Appellate Chamber of the Higher Anti-Corruption Court upheld the acquittal of three former officials of PJSC “Ukrzaliznytsia” in the case of abuse of office during the provision of preferential rates for railway freight transportation.

As you know, the anti-corruption court acquitted the former deputy general director of Ukrzaliznytsia Pyotr Naumenko, ex-director of the Department of Commercial Work of the UZ Yuriy Merkulov, and the deputy head of the branch for commercial issues of the Center for Transport Logistics of the UZ Lilia Petrenko from accusations of abuse. Disagreeing with this decision, the SAP prosecutor appealed the verdict.

“On November 18, 2022, the AP VAKS completed the review of the appeal against the VAKS verdict of February 18, 2022 on the acquittal of the former members of the Tariff Commission of the UZ for damages caused to the state-owned enterprise. According to the results of the review, the panel of judges left the prosecution’s appeal unsatisfied, and the VAKS acquittal verdict remained unchanged.”the court informs.

The decision entered into legal force from the moment of its announcement and can be appealed to the Criminal Court of Cassation of the Supreme Court.

According to the indictment, in 2014, three UZ officials who were part of the Tariff Commission of the State Administration of Railway Transport of Ukraine – the collegial body of “Ukrzaliznytsia” (sets preferential tariffs for freight rail transportation) abused their official position. According to the legislation, preferential tariffs for cargo transportation were provided on the condition that forwarding organizations must fulfill the guaranteed volume of transportation.

At the beginning of 2014, with the participation of the defendants, the Tariff Commission made a decision to establish preferential tariffs for a number of forwarding companies, which subsequently did not fulfill their obligations regarding the guaranteed volume of transportation, but still received benefits from UZ. As a result of such actions, the company did not receive 7.3 million dollars of income (as of the date of the crime, 69 million UAH), which was confirmed by two conclusions of the forensic economic examination.

We will remind you that the case itself was submitted to the court in May 2018. In July 2020, VAKS scheduled a preparatory meeting in it.
